Garden State Equality v. Dow Changed New Jersey Law Even Beyond LGBTQ+ Couples and Families

Today, October 21, , Garden State Equality joins thousands of committed LGBTQ+ couples and their families in celebrating the official 10th anniversary of marriage equality in New Jersey. That was the effective date of then-Mercer County Assignment Judge Mary C. Jacobson’s landmark ruling in Garden State Equality v. Dow, holding that New Jersey&#;s marriage laws violated the rights of same-sex couples to equal protection of the law under the New Jersey State Constitution.
Judge Jacobson rejected then-Governor Christie’s request for a “stay” to delay her court decision in favor of marriage equality. After Judge Jacobson&#;s refusal, the New Jersey Supreme Court stepped in and upheld the stay, ruling that New Jersey’s LGBTQ+ civil union partners were denied equality. In a unanimous ruling authored by Chief Justice Stuart Rabner, the High Court said, “the state has advanced a number of arguments, but none of them overcome this reality: Same-sex couples who cannot marry are not treated equally under the law today.” The justices he
Judge Jacobson ruled on April 9, that Bridget Kelly, Gov. Christie’s former deputy chief of staff, and Bill Stepien, the governor's former campaign manager, do not have to hand over documents subpoenaed by the New Jersey Legislature. The subpoenas came as the result of the "Bridgegate" scandal in which traffic jams on the George Washington Bridge were allegedly orchestrated by members of Gov. Christie's administration as an act of political revenge. The New Jersey Select Committee on Investigations, while looking into the matter, subpoenaed Kelly and Stepien in order to obtain further evidence in the scandal. According to the court, the committee requested "all communications, documents, and phone records relating to the lane closures."[9] When the requests were denied, the committee sought a court order requiring Kelly and Stepien to comply with the subpoenas.[10]

What I found as I lived through this nightmare was my story was not remarkably unique. While the injuries to my family and my two precious children (ages 2 & 4) when the divorce proceedings started is obviously uniquely a personal injury&#;. the family court process and the repetitive, systemic, unlawful conduct by the judges and lawyers involved was not unique at all.
